These terms cover Hey Valerie Custom Songs ("the Service"), offered by The Commons 1854 (operated by Martino Grill LLC, Topsfield, Massachusetts). By ordering a custom song, you agree to these terms.
A custom song is an original, AI-assisted musical recording created from the details you provide. It is a personalized digital product.
The product
We write original lyrics from the information you share and produce a recorded song in the style and voice you select. Because every song is uniquely interpreted from your inputs, the final result may differ from what you pictured. We aim to create something you love, but we cannot guarantee a specific emotional response or exact creative outcome.
Songs are delivered digitally (MP3) via a private link to the email you provide and inside your portal, where applicable.
Orders and payment
Prices are shown at checkout in US dollars and are charged at the time of purchase through our payment processor, Stripe. Promotions and pricing may change at any time.
You confirm that the payment method is yours and authorized, and that the information you provide is accurate and your own (or that you have permission to use any names or details about others).
Delivery
Songs are typically delivered within minutes of a successful payment. Delivery is complete when the song link is made available to you by email or in your portal. Please check spam/junk folders if you do not see it, and make sure your email address is correct.
If a delivery genuinely fails on our end, contact us and we will re-deliver at no charge.
Refunds, corrections and our guarantee
We want you to be happy with your song. If there is a mistake (a wrong name, a misheard detail, or a clear error on our part), email us and we will correct or re-make it at no additional charge.
If we are unable to deliver your song at all due to a problem on our end, you are entitled to a full refund.
Because songs are custom, AI-generated digital products produced immediately, we are generally unable to offer refunds simply for a change of heart once a song has been generated and delivered — but we will always work with you to make a reasonable correction or re-record first. If you believe a charge is in error, please contact us before disputing it so we can make it right quickly.
Your content and ownership
You keep ownership of the personal details and memories you share. By submitting them, you give us permission to use them to create, deliver, and support your song.
Your finished song is yours to keep, play, and share for personal, non-commercial use — at your wedding, your event, with family and friends. If you would like to use a song commercially, contact us.
You agree not to submit content you do not have the right to use, and not to request anything unlawful, hateful, or that impersonates others.
Acceptable use
The Service is for lawful, personal use only. Do not use it to harass, defame, infringe on others’ rights, or violate any law. We may decline or cancel an order at our discretion and will refund any payment for an order we choose not to fulfill.
Disclaimer and limitation of liability
The Service is provided "as is." To the fullest extent permitted by law, our total liability for any order is limited to the amount you paid for that order. We are not liable for indirect or incidental damages. Our preferred remedy is always to correct, re-deliver, or refund.
